    Using Ch 13 to Stop Foreclosure

    If a husband and wife are co-debtors on a mortgage in foreclosure, will an individual Ch. 13 filing by one (e.g., the husband) stop the foreclosure? Or do both need to file either individually or jointly?

    Chapter 13 generally protects the cosigner, which is one of the benifits vs a Chapter 7. In a 7, you file, your cosigner gets stuck with the bill. I do not believe that is the case in a 13.
