The preliminary hearing to lift the stay by the second mortgage company is scheduled for 8/6. We've contacted the movant's attorney three times with no results. What happens at the hearing? What do I need to bring? What if the attorney doesn't contact us? I thought we were supposed to try to come to an agreement? We did miss some payments but less than half the total the second mortgage claims.
There is equity in the home. We are current with the first mortgage since we filed but there is an arrearage for both the first and second mortgage company included in the plan. The house is still listed for auction by the first mortgage company. It just keeps getting postponed. Trustee in a letter that we would have been confirmed -- filed August 2012 -- but won't be until the results of this hearing.
