    Much Better

    So the meeting went well. The bad part was they wanted $1274 to file but I was actually referring to this office by a trustee so I gave them $100 and hope to pay the rest REAL soon and get this going. Payment is SUPPOSED to be around $890.00 for 4 years which his wonderful I was hoping for under $1000. The bug question which of course I didn't ask at all or even have on the list to ask is what about my car payments??? Do I make them they are due Friday and if I didn't make them I could pay for most of this? But I am already a month behind and don't want to take the chance of getting them repossed??? Any suggestions? I guess I could call and ask but I am sure they would tell me do what I can.

    My lawyer said that if your payments aren't current when you enter the plan, the vehicle can be reposessed - NOW, I don't know if that applies in your state - BUT, you defiantely need to clarify this issue with your lawyer.

      That's not very good news I am already a month behind on them both.

        i was 3 payments behind on my car , once i filed i was protected , my attorney called the creditor the day i got my case # and so far they havent called back

          You are chapter 13, which allows you to catch up on secured credit. Yes, you can skip your car payment to pay your attorney. It might mean your Chapter 13 payment goes up as you will have to pay back the entire arrears for your secured debt.

          You won't lose your vehical if you want to keep it. That is one of the benifits of Chapter 13.

            I made one of the payments but not the other it was due the 28th they are calling threatening repossesion. Since I have not filed yet can't they do that?

              Until you file, you are a sitting duck. Try to work out something to pay just a little and keep them satisfied until you can file. We stopped paying our car payments after we had filed, once you file you have bankruptcy protection. Good luck.
