    deducting payment from paycheck

    Hi everyone i have been lurking here for awhile but this is my first post , i filed chap 13th on june 28th and received my case # the same day , i got a letter today from my attorney that said the trustee would prob want to have the payment deducted directly from my paycheck , i work at a business with only 3 employess , and im hoping that will make a difference i really dont want everyone to know my business , the owner posts the checks on a computer that everyone uses so it would be easy for anyone to see it , thats the only thing that bothers me , well that and the creditor i talked to today ... she really made me feel like garbage but i guess thats to be expected , ive learned alot from this board

    Ask the trustee if you can do direct deposit from your checking account to the trustees fund.

      Welcome to the chapter 13 club,

      If you do end up with payroll deduction, than remember that you do not have to explain to anyone why you filed and politely ask them not to ask anymore.

      If any creditor calls you again, tell them your lawyers’ name and phone # only and tell them they are now in violating of a court order stay not to contact you. If they call back again; report them to your lawyer.

      We all already feel bad enough about filing bankruptcy and we don’t need any pain in the ass creditor telling us again.

        My husband also works for a small company and we didn't want to do a wage order because it could affect his employment, so our attorney asked the judge to let us direct pay because of those circumstances and he signed the order. Ask your attorney if he can submit an order to allow you to direct pay.

          Well, I work for a rather large corporation, and all the paper work gets sent to Detroit, so I am not concerned about the locals finding out. Only problem, seems at this company, anything that goes on through HR up north ends up getting back down to KC.

          I decided to go ahead and have it taken out of my check so I could quit worrying about it. 2 months have passed since I filled out the papers, so far, it hasn't been taken out yet.

            I know what you mean, my husband worked for a guy and was the only employee exceptfor a parttime secretary. His boss was not only judgmental but hated any extra "redtape". In that case it worked much better for me to have the payments taken from my check, I work for a huge company where the payroll is done in a completely different state. They even have a couple people on the payroll department with the title of "bankruptcy and garnishment" specialist---which told me I wasnt the only one! LOL
