    Question about Confirmed plan, and Tax return.And new baby

    My Chapter 13 was confirmed, and the letter from the court stated that as long as I keep my payments on time, the plan will for 36 months.My question is as follows. They never mentioned anything about income taxe refunds at any point during the 341, or the confirmation letter.Will they get my tax refund at the end of the year? Also, At work, I've had some overtime due to us being shorthanded 4 employees at work.That will cease come Septemer, but until then I have gotten some extra hours.We're having our 3rd child in December, and my wife will be off work November, and December , leading me to work all I can to cover bills the 2 months she will not get paid (About 2,000.00 she will not get paid during the 2 missed months.Will that be an issue, or do any of you good people think it'll be ok.I certainly don't want to overdo it,but like I said earlier, after next month the O.T will stop as we will have 3 new people hired at work.

    Since your paycheck is going up because of overtime and your wife, her's is decreasing because of baby, you pretty well balance your self out..... so no reason to notify Trustee.

    BUT - if you had a major increase in salary (10% or mor) then you have to notify the Trustee of income changes.......

    Overtime that is temp is a one shot thing and won't affect your plan unless continous......

      Make sure you adjust your withholdings so that you won't be getting a refund--nor having to pay. Better having the money in your hands than the governments not gaining interest.

        I did adjust my withholdings after filing my CH. 13 in 2004.

        Luckily, I have not had a problem in receiving my tax refund (North Georgia District) for the past two years. The IRS did confirm the status of my account with the trustee office prior to releasing the checks.
        09/16/2004 - Filed Ch 13
        10/28/2004 - 341 Meeting - done
        12/16/2004 - Date Confirmed
        - Date Closed
