    Who owns debt

    Friday is my 341 meeting and I have wondering. Right before I declared BK 3 of my creditors sold my account to CA. So I have been wondering, who actually now owns the debt. Of course the CAs are not listed in my Ch 7 petion, since at the time the paperwork was done I did not know they existed.

    In the end, who am I dealing with?

    It depends. Strictly speaking, collection agencies do not take ownership of the debt, they are third parties who provide collection services. Debt purchasers on the otherhand, purchase the note from the original creditor, in which case, all rights owed the original creditor now belong to the debt purchaser.

    Since the sale happened relatively quickly around the time you filed BK, you shouldn't have much problem. Debt Purchasers rarely do anything in BK.
