    ? about irs refunds

    My husband and I had our 341 meeting on 9/11/06. The trustee did not mention anything about our tax return. I think I successfully exempted them using the wildcard exemption. Am I alright in thinking that I wont have to turn those over? It just seems to good to be true to me.

    I would just not worry about it for now. Your discharge will be due in 60 days, which is before 07 when you would file for your refund anyways. If your discharge comes as scheduled, then your refund will be all yours.

      That would be nice. Our attorney said since we filed in August, the trustee was entitled to claim 8/12's of any return. He said it's hit or miss on whether the trustee will in fact move to make it an asset case and want the return. Hopefully you get to keep any return since it wasn't mentioned!

        During tax filing season and late in the year are when Trustees express the most interest in income tax returns. Lucky people that file and get discharged during summer months.

        As Mac said, this late in the year, it is hit or miss whether the Trustee will make your Discharge contingent on surrender of your income tax refund.
