    341 getting really close

    It's scheduled for this Friday at 10 am and I am getting so nervous and scared! Everything looks good on paper but I keep thinking the worst. The only paperwork that the Trustee has asked for is our last 2 income tax returns (this is good right??)

    Guess I just need some hand holding and a shoulder to lean on!

    Connie you sound just like I was just before my 341 meeting.I too went pro-se and was freaking out at the last moment.I scrambled to put more paperwork in my folder because I was afraid the Trustee might ask me for it and I would look stupid if I was not able to produce it.But I just had my 341 and all the Trustee asked for was my ID and Social security card! I brought a ton of paper work and he did not even ask for it! He asked the standard questions and then said Thank you and have a nice day. That's it!
    Really,beleive me, you'll be OK!! It is so simple and quick you won't beleive it's over siss-boom-bah.....RELAX!!!! Trust me.

      Thanks for the pep talk Donna. We actually filed with a lawyer, so knowing she is "overseeing" all of this is a big help. I too have a big folder filled with all sorts of paperwork "just in case" I don't want to get caught unprepared for anything.

          Piece of cake, until the trustee pissed my lawyer off. They didn't like my repayment proposal, so that is a hindrance, now i go before the judge and let him decide what i should be paying, but bet he wants more too (more for their pockets). anywho, no creditors showed up at the meeting, its just one big confirmation to make sure you are who you say you are. no worries, especially since you got lawyer, more power to you!

            if yoru case is straigt-foreward and there's nothing awkward about it - i wouldn't sweat it. If your case is on the edge - then be prepared.

            remember - talk only as much as you need to. Don't go off and babble.

              Best of luck to you Connie. Ours was really easy. In fact, they asked for bank statements as well as the balance of our accounts on the day we filed. She looked at them but then she gave them back which I was surprised at. I was thinking that they were gonna keep them and look them over with a fine tooth comb. It's easy to say don't worry, but I did too. You just feel so "at their mercy" and it's kind of a not so great feeling. However, me and hubby walked out of there thinking "that's it"?

              Just know that we are all here for you and you have a courtroom full of friends who have been there, done that. Best of luck and keep us posted.

                I sometimes think going to a 341 is like having a police car following you--even though you've done nothing wrong, all of the sudden you sit up straight, slow down, put your hands on 2 and 10 o'clock, and are extra cautious.

                Remember, you have a legal right to file, and as long as you've filled out your paperwork thoroughly and accurately, you should be fine.

                    Best advice: Don't say stuff that'll put you on the radar.

                    Trustee's don't want to be seen as pushovers, and they have bosses.

                    They have 7 other hours of the day - and they want *some* work to do. Usually they'll 'red flag' 2 or 3 app's during the 341 and investigate them further.

                    If you babble, or appear nervous, or have a lot of 'but this, and but this, and this' in your bk - expect them to look at it more closely.

                    I wish I could find % of bk's that are dismissed, city by city - but they keep that info very top secret. So people don't 'bk shop' after noticing phoenix has 95% approval rate and la 67%.

                    Just act like it's a very straightforeward app - and let the trustee grill the next person.

                      You all have been great! Someone said once before to look at your bk as a business decision. All of my paperwork is in order, everything on paper can be documented and proved with receipts, forms etc. I hate that this had to happen to us, but without a bk we truly would have lost everything. I am looking forward to the time when I can be debt free, work on rebuilding my credit and getting on with my life!

                      Thanks for all the great advice, I will be (try) calm, cool and collected at the 341, just answer whats asked of me and go from there. My attorney seems to think there will not be a problem so here's hoping.
