    Can we move?

    Hello everyone! Seems I need your expertise again. My husband and I have been looking for a place to move to with lower rent. We have found a beautiful home for 200 less per month, on a lot less busier road, and it has central heat. (we currently have oil for the heat and hot water and the cost is killing us)

    I was wondering if it was alright to move now or will the trustee try to push us into a chapter 13 since our expenses would go down? Any input will be greatly appreciated.

    When it all boils down to it, its just numbers! Your credit score, your interest rate, your bank account, and your net worth if you're fortunate enough to have one......is your happiness really defined by numbers?

      Oh, sorry, I guess that would be helpful. We filed August 2nd, our 341 was 9/11 and due to be discharge 11/11.

        Were you near median income level or pretty far below? If you were pretty far below, he/she could try but maybe wouldn't, but I would hate that possibility floating overhead.

        You could just try to play it safe by waiting for the discharge.

        I'm not sure if maybe you should wait even further until it's completly closed. I would ask the lawyer to be sure. Its a good question.

          We were way below median income, like less than half. I cant ask an attorney because we filed prose. I was thinking the same thing as you credithater that it would be a lot safer to move once we are closed. The only thing is, that in our neighborhood 1,000 for rent a month is a steal. I would hate to let it go and then who knows if we would be able to find something like that again. I am just so tempted to take my chances.

          I am not sure if this will help in the determination but on pacer the trustee has already asked that he be relieved of his duties and the case be discharged. That was 4 days after our 341.

            I hear ya about when an opportunity arises.

            hmmm, thats a good sign he is showing discharged. Is there anyway the trustee could find out you moved and your $$ situation has changed? If not, then just be careful who you inform that you moved.

            Maybe someone went through a similar situation and can chime in.

              Thanks Credithater, I think I would have to call the trustee's office and inform him of the move. I am going to check on that now to make sure.
