We filed bk last Oct. 2005. We were discharged on 1/18/2006 as an asset case because of tax returns. I sent off my tax returns to the trustee as requested back in Feb. of this year. We still have not heard anything from our trustee as what to do with the check. I called our attorney and was told the trustee would contact and request any money she is entitled to. I have made several phone calls and sent one letter to the trustee with no response. My old car bit the dust and I had to cash the check to put a down payment on the new car. I still have the portion the trustee is entitled to, so should it be a problem that I cashed the check? On Pacer, it show the trustee withdrew her report of no distribution in May, but still no news. It has been over a year since we filed and almost 10 months since I sent in my tax returns. Do they have a time limit to finish things up? I am in Fl by the way. Thanks for any help.

We are finding that the Trustees take their time if the case becomes an asset case. However, I find it strange that the trustee did not notify your attorney as to what portion of the refund he wants.
In our case we mailed the check to attorney, who sent it to trustee, who then returned our portion of the check. Case is still not closed. Our attorney says it can take up to six months to close case after proof of claims are issued.
