Take my tax refund???

I am married and will be filing singly. We will most likely be getting a tax refund. I know I can use a "wildcard" exemption for $400 here in Oregon. But the remainder is what concerns me. Can they take the whole thing or not since husband is not filing? Will he be able to keep a portion of it?

If Oregon is a community property state, than the Trustee would be entitled to take your 1/2 interest in the tax refund (minus the $400 exemption). If Oregon is not a community property state, than I am not sure what happens exactly.
