    Most of my concerns are behind me now

    We met with the lawyer yesterday to make any corrections that needed to be done before he files. As soon as I get back to him with the amount in our daughter's bank CD that I mentioned to him today (I thought my husband had that information along today but he didn't, so I have to phone in the information today), he'll do the filing for us either later today or over the weekend (electronically). He said it really shouldn't be a problem, though, because of the amount that it is (something like $750) and it would fall under exemptions. Our daughter is 21 years old today and my husband just transferred the account entirely over to her a little over a month ago, and we wanted to bring that up because technically I guess it was transferring over $600 within the past ...um, 6 months? I forget what the time period is there that they require. It was in both of their names before. We kept procrastinating putting it entirely in her name, so now it's all hers, and I hope it won't be a problem because it was actually her money all along that has been building up since she was born. I suppose it doesn't sound like much, but we never had much to give our kids. Most of the money they ever had came from their grandparents.

    Anyway, as far as my concerns being lessened....Our lawyer is really easygoing and unlike the criminal lawyer that my husband had earlier this year, I feel totally comfortable around this one. He's not intimidating at all. He told me that in all the cases that he's done (and he's done a lot), he's never had any objections from creditors. He said it's not like they can just say, "Oh no, we want our money, we object!" Also, he said that the trustee is a really nice guy and our lawyer said, "He'll be on your side." Our lawyer also offered to go with me next month when other people are having their 341 meetings and take me in to see what goes on in one. He's doing this just as a courtesy to rest my fears. I told him I have anxiety, which I do, and I thought that was real nice of him to offer to do that. He said our 341 will most likely be the first Wednesday in January, which would be January 3rd. It would have been the beginning of December if he could have filed last week like he was going to, but we had corrections to make on the paperwork. If things go as easily as what the lawyer seems to think they will, I think my mind can be pretty much at ease now....I hope.

    Yomama, sounds like you have gotten a great lawyer. I hope your 341 goes smoothly, but until then, don't worry yourself about it like I did, just enjoy the holidays with your family and let your lawyer take care of everything else!

      Yes, I really like our lawyer a lot and have a lot of confidence in him. One thing I like about him is you can tell that he doesn't think he's better than other people, which is hard to find in lawyers, from our experience anyway. He sits down with us and never makes us feel rushed and takes his time with us explaining things, etc. I feel like we couldn't have made a better choice. I have faith that he will do right by us. Yes, I will enjoy the holidays and try not to think too much about this whole thing.
