    Payday Loans

    We are going to be trying to convert our Chapter 7 to a Chapter 13, as I stated in an earlier post. The attorney stated that during the conversion we can list any new debts that we have incurred, we have 4 payday loans out, 3 of which we stopped payment on the checks and 1 that I don't know what to do with. The amounts are all under $1,000.00, the attorney asked when these were took out and I don't know how to answer this, we have had these for probably 6 months but keep paying the interest to roll over and then each 3rd time they have to be paid off in full and we retake it out (there might . A new contract is signed every 2 weeks. Can these be included in the bankruptcy? Next question is, when we went to stop payment on the checks(attorney told us to) we didn't have one of the check numbers and it was due that day, by the time we got home and went to do the stop payment they had alredy deposited the check into our account and received the funds, this caused us to have several bounced checks. To clear this up we had to go and retake the payday loan back out the next day, or we would've kept bouncing checks with a $24.00 charge on each one. Should we stop payment on this check also and include it in the bankruptcy, we are going to be filing the conversion paperwork from 13 to 7 on 3/17 as long as all goes well. Any advice will be appreciated.
