    Been away for a while...new question

    Well - not away, just SO busy - and things were going as everyone had said "awaiting discharge".....then 2 weeks ago Sovereign Bank decided they wanted to reaffirm my note with them for my husband's motorcyle - not a problem - I went to my attorney's office, signed, went home....now we have gotten a Notice of Nonevidentiary Hearing regarding the reaffirmation agreement....what the heck is this! My attorney said it's a waste of time - I wish I had the same attitude as him, but HELLO....I am the one whose neck is on the line here!

    Anyone?

    Yes, it will be a waste of time. It is a little odd to have to go to hearing on a reaffirmation when you are represented by an attorney, (but at the same time, its not unheard of). Basically, the hearing is where the judge makes sure you understand the implications of a reaffirmation agreement.

      That's what I thought, but just wanted to make sure.

      Ahhh the pins and needles - tomorrow is my deadline for objections - funny though, we had a $500 medical bill in our matrix and we are NOW getting collections calls....(meeting was back in November hmmm) - does this mean I can get the collections agency in trouble?

        Yeah, but you probably should notify your attorney and see if s/he can give the creditor a stern warning about violating the automatic stay.

          Well, I've given them the case number, so hopefully they will go away! I wonder though, this collections agency said they had no knowledge of the bankruptcy (that was filed in like October....) - they deadline for objections was Monday - does this mean they can't object under the guise of not being notified (although the hospital was?)

          We had our "non evidentiary hearing" today - and the judge actually denied the reaffirmation agreement - said it was in our best interest. The attorney explained that it is still ok, they won't take the bike as long as we make our payments as promised....hope that's true - the thing is a life saver in the summer when my husband's job sites are over two hours away....much less money per week than the diesel truck!
