    Means Test Question

    Using the means test on the LegalConsumer.com site, I fail to see where payments for auto insurance go. I expect it is part of the IRS allowance for vehicle expenses, but in Texas the insurance companies use your credit scores to boost your rates. The form uses the amount from your outstanding loan balances and doesn't ask anywhere for auto insurance which is required by law in Texas. Plus what about yearly license fees? Anyone who has gone through all this, does the form the attorney use look a lot different from the online thing at LegalConsumer.com? Are there any better online means test forms out there?

    I had these questions as well about the insurance and plates. I was also wondering about things like tires and maintence on our vehicles. There is no place on the means test to put these expenses. Another issue I am pondering is do I include my out of pocket health care limits. We have a 250. per person out of pocket deductable and a co pay do I average this out and put it under health care expense?

      I have the same issue on medical. We have deductibles (which being January, apply right now) and something called co-insurance, like 90-10, 80-20. Plus how do you account for gasoline expenses (there is a vehicle operation cost area which I presume accounts for it)? One other thing is I owe about $1500 in late fees on one car - I assume I add that in as a cure amount for a secured debt - is that correct?

      Time to vote the reps and Senators that passed this garbage legislation out of office.

        Not sure Walnut I think we are just going to have to wait for our BK expert friends here to to lead us in the right direction! You and I are on the same page at this time in our life as far as our questions! lol

          Car payments, gasoline, insurance, and such,.......... Auto related Expenses are accounted for on the Means Test thru the Schedules Allowables for Cost of Ownership and Transportation costs.

          Medical is based on what you actually spend. If you don't have receipts from last year, go back thru your check book, CC statements, however you may have paid medicals expenses. Doctor's office, dentist, pharmacy, whatnot. And don't forget to include your over the counter medicals as well. Tylenol, ibuprophen, bandaids, and such.

            Also be sure to allow yourself a reasonable amount for automotive maintenance (they do allow that to be factored in). On any yearly cost, such as vehicle registration, inspection etc. take that yearly cost and divide it to get a monthly figure, same is said for medical.
