    Help!

    So I had posted that we had a hearing before the judge where he chose to deny the reaffirmation agreement we were going to sign with the lender on my husband's motorcycle....and that I have been waiting patiently.....

    We get a letter from my attorney yesterday with a fax from the Trustee enclosed - he is requesting our bank statements (checking and savings), all cancelled checks, as well as more information about my husbands truck (a 2001 free and clear of a loan, with about 200k on it for miles) and the bike (were modifications made to improve the value, etc....big fat no on that one too)

    What do you guys think? I am thinking maybe the trustee is saying there's no way we are going to be able to keep up with the bike payments (although, I have been on time every time for the past 3 years). There is MINIMAL equity in the bike as well (like maybe a $200 difference)....

    I guess I'm just freaking out...as usual!

    I looked back in your old posts and saw you live in Massachusetts. Were you over or under the Median when you filed??

    Did you use State or Federal Exemptions?? Did you both file Joint??

    The vehicles issue may have to do with your Vehicle Exemption and how it was applied.

    Requesting 2 years worth of CC and Bank Statements, and cancelled checks could be any number of things.
    Filed Ch 7 - 09/06
    Discharged - 12/2006
    Officially Declared No Asset - 03/2007
    Closed - 04/2007

      We filed jointly, and were JUST under the median....I guess we'll have to see what happens....

        Not a big deal, just keep up with the payments, insurance, etc and keep the bike. I never reaffirmed mine and haven't had a problem (yet!)....

          I'm just thinking that they are looking closer into our finances, because the judge "suggested" to me at the hearing that it might be a good idea to "go without" the bike for a while (and believe me, I am seriously thinking along the same lines, although my husband will argue til the day is done that it saves us money in the long run because he rides to work every day from early May through the end of October at least....) - pins and needles pins and needles....I can't wait til I can sleep again!
