    Timing of Tax Return ?

    We got our state return in the mail today. Expecting federal soon.

    Will be filing soon. Is it best to not even cash them? Is it automatic that they will take it, (or ask for it back)?

    If you use the money for living expenses or a legitimate purpose (like paying for your attorney, filing fee, unexpected doctor's visit, etc.), you're free to spend your tax refunds. The main problem with tax refunds is if you get them *after* filing - then, you can't spend them at all, even on legitimate expenses.

      I think this is one of those things that vary by district/trustee and also by the amount of your refund. We received our refund before filing and were told by our lawyer it was fine to spend on whatever we wanted as long as 1. we could exempt it (which we did) and 2. as long as it was'nt over $2000 (which it was'nt). You don't say how much your refund is...

      Ask your lawyer about it or if you don't have one yet set up a free consultation and ask about it then.
