    Mortgage Question

    To make a long story short, Homecomings, our mortgage holder didn't do reaff. during our bankruptcy. We didn't pay mortgage becuase they were not doing it (stupid I know, we don't have a good atty). November 2006, they filed claim against the bankruptcy estate. Early December they said they wouldn't do the reaff unless we make mortgage current witch we immediately did. Mortgage was made current in December and has been. Homecomings, other than not doing reaff has given us no trouble. The last person we spoke with said as long as you keep paying, you are fine. In fact last December they gave us the option of doing the automatic bank draft again and reopened all of our account access online. Besides being in a suspense acct which they always apply payments to the mortgage with out problem.

    Today we got our portion of our tax return from the trustee and included was an challege to the claim Homecomings filed in December. Her paper work says that since she didn't take position of the house she was challenging it. She has given them 30 days to respond. In the letter she sent us, it says we should be closed within 60 days.

    Anyway, I am freaking out. Do you think we have anything to worry about?

    Of course we will call atty in the morning.

    Homecomings gave us hell about our mortgage. Always paid mortgage and never went 30 days past due. In Dec. (ironic that your troubles started in dec) they said we were 30 days past due, which was completely untrue. They just took forever to post our Nov. paymetn. We had to attend a hearing, bring in documentation showing our payment cleared our bank, and of course had to pay additional attorney fees. It was a month of hell, since they refused to accept our Dec. payment and finally on Jan. 31 their attorney accepted payment from us. We had to pay our Dec., Jan & Feb. payments in order for them to cancel the stay. It then took forever for their attorney to forward the payment and our March payment was paid to the attorney since Homecomings still would not accept it. Good Luck!
