    Can they ask this q?

    Another thought: I will not be working for perhaps the next 3 years. I will be going back to college, and my wife will be supporting us.

    Can I be asked, at the 341 meeting, why I am not presently working, and if I intend to go back to work? Or if I have been looking for employment?

      If your case raises a lot of red flags, the trustee may indeed ask you this question, or a question similiar to that. But don't loose a lot of sleep over it. Just answer the question briefly and honestly, if it's asked.

        If you are filing a chapter 13 with your wife and she makes enough money to meet monthly obligations and has excess money left over to fund the plan. I don't see the trustee asking you any questions regarding when or if you are going back to work. What your attorney will explain to you, is if you get employed that income must be reported. The trustee's main concern is that there is enough money to fund the plan.

        I filed a chapter 13, two years ago. And I am still in plan. And I honestly can't see the trustee asking that question. But if you are seriously seeking filing bankruptcy, youmight want to put school off for a minute and work and help your wife with getting out of debt. Just my opinion.But considering that your choice of not working for 3 years raises red flags for me, I sure it might raise some red flags for the trustee.

          The truth is, no one here can gaurantee whether or not the trustee will ask you this question! And rather than loosing sleep over the liklihood...........the best thing you can do is prepare for the worse, and hope for the best!

            The question you need to be prepared to answer is "how do you expect to pay for college".
