    Judgements and Chapter 7 (CA)

    Is it true that judgements are not automatically dismissed in Chapter 7? Where are they to be listed in the bk papers, and is listing them enough? I am planning to file Chapter 7 and if anyone knows the procedure to discharge judgements PLEASE REPLY.

    Judgements listed are discharged depending on what kind they are. Run of the mill credit card judgements etc. We will be getting our eviction judgment discharged but if you commit a crime that had fees attached that may not be a dischargable judgement. Also, You have to go officially vacate a judgment through court proceedure if you can prove the judgement was in error and needed to be wiped off your record. i have heard that it is possible to claim bankruptcy as a good excuse to have it wiped clean but not sure how it is done. Get a lawyer.

      If you have civil judgments against you, get a lawyer to handle you BK. Generally, you have to file a Motion to Avoid Lien in order to discharge a judgment, such a motion is an additional proceeding in BK court, simply listing the judgment in you BK paperwork does not extinquish the lien that is created by the judgment.
