will the trustee Abandon property

how long does it take for the trustee to abandon my property in a chapter 7 bankruptcy no asset case GA. How do they determine if you have assets other than what you say.

I am not hiding anything I just wanted to know do they go by the county tax appraisel on the property (my house) or do they appraise it themself or have it appraised. I am just really curious as to what goes on behind the scenes because I am anxiously awaiting the trustees decision as to wheather or not they are going to abandon my property I really want to sale my house it is claimed as exempt but I do know I can do nothing before she abandons her interest in it. I just want to move from this awefull town and I can not move unless I sale I would only make 3 to 5 thousand from it after payoff but that gives me the money I need to move also , can I sale before discharge if the trustee abandons it and do I need special permission to do so? Will they keep the money made from the sale? We filed pro se and alot of attorneys refuse to give any advice because I did not hire them?

I am from GA, and I would highly reccommend not hiding anything. They will find it.

Your question is very vague -- is this real "land" property or something else. Does it have real value or just sentimantal value.

IN GA how long before

how long after the 341 in a chapter 7 before the trustee files the report claiming that you have no assets . How long after discharge does it typically take to get the case closed? And how long after it closes are they still watching your every financial or is it actually over after that I am asking because I hear of cases being re opened.

Trustee's rarely, officially, abandon property prior to discharge. Reason being, all exempt property is returned to the debtor upon discharge (i.e the BK estate terminates upon discharge). Thus, unless there is a pressing need, the trustee will not file any document abandoning property. In my experience, the only time the Trustee will file a notice of Abandonment is for lawsuits when the debtor is the plaintiff and the Trustee does not want to take over the case.

When it come to real estate, (or any other hard assets, i.e car, boat, ATV, TV, etc), you will likely have to wait until discharge.

If you are indeed a no asset case when you receive your discharge the trustee will "abandon" the property of the estate back to the owner. That would be you. I would suggest you do not sell it until you have been discharged and closed as it is still part of the bankruptcy estate until then. It typically takes 60 days from the time of your 341 to the day of discharge, closing could take a bit longer. You will receive notification in the mail from the courts when you are discharged and when you are closed.
