    Filing chpter 7

    i am trying to figure out waht to do with filing a chapter 7 bankruptcy. i just came out of a divorce, and i owe way to much. i looked at using an attorney but i cant come up with the money that he wants. any suggestions. i saw a couple online that i could use, but i am a little leary about using them help please

    With choosing an attorney, my advice is to sit sown with 3 to 4 and get a feel for them. The consultations are free. Anyways, some attorneys are great and will take the time to go over everything with you and some will be short, leaving you even more confused. This is a judgement call you're going to have to make on your own. Sorry.

    As for paying them, you may find an attorney that is willing to work with you and except payment arragements. The negative side to this is if you don't have any money, nor an income, you're paperwork will sit on the attorneys desk until you've paid him/her in full. The upside though is that if you're not paying any debts, that money can be used to pay an attorney.

    Chapter 7 filed - 10/12/2005 - Asset
    Discharged - 02/16/2006
    Case Closed - 11/08/2007

      When I filed I had 0 money and I do mean 0 so I did it myself. I studied the court sites online for NY State. All the paperwork, information, instructions and forms are there and I took my time and made sure everything was in order. It came out perfect. The trustee asked me how I did it by myself.

        If you stopped paying everything immediately, could you afford an attorney?

        One thing to consider is that if you as part of the divorce decree have court ordered alimony or child support payments thos e are considered non dischareable debts in a bankruptcy.

        If you are paying credit cards or rent to own places, stop paying them now, and use that money to help yourself.

        You can attempt to file Pro Se if you find no way to get the money for a lawyer (mine offered a payment plan). You'll need to study up hard and look at a lot of cases and get all the info you need. It can be tough but folks have done it.
        May 31st, 2007: Petition Filed by my lawyer
        July 2nd, 2007: 341 Meeting Held
        September 4th, 2007: Discharged and Closed.
