    Filing ProSe in CA, Need Help!

    Hi ProSefromCA, here I am joining you on this journey to freedom (hopefully).

    On January of this year I went to the Bk court and bought the Ch7 petition for about $15-$17. It is thick! I was wondering what forms I need to file out of that booklet if I haven't worked for about 1-2years now, am a full-time UCR student (financial aid), mother to two baby boys of which one is disabled, on cash aid and my only property is a 2000 dodge caravan.

    I have nothing but debts! I also turned in my car=reposession, and would like to know if the difference can also be discharged with BK.

    I took your post off that other thread and started a new thread for you. You're more likely to get better responses to your questions this way.

    What District and Court in California will you be filing in?

    There may be help available to you at the Court's home web page. Also, other folks here may have filed in the same Court. They can give you info based on their own experiences.

      Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

        Nice to have some Pro Se company, especially in Cali! Hopefully, we can get even more over the days. I got a packet the same as you did, but years ago when I was considering beating the new law deadline. So what I have is out of date. It's thick, but they probably gave you 2 copies like me which are needed to file. Are you also in the Central District? It will say in the heading of your paperwork.

        Your paperwork is probably okay, but I did see that some minor things were revised in April. What I plan to do is get all the forms online. This is free from the gov website. There is also a PDF version I need to investigate that let's you type directly into the PDF. The book I got recommends typing, or using a preparation service, unless you have neat handwriting. So, I figure doing everything by computer, and online is the easiest route. I would really recommend you get the book if you can spare the $25. It's well worth it instead of attorneys fees to walk through the papers. I'm using that, this forum, and the web, and hope to come out okay! The answer to your 1st question is that you must fill out the paperwork completely, but many pages will not apply to simple cases such as ours, so we only mark 'none' for some pages.

        For your other question, I fairly positive the answer is Yes. Chapter 7 erases ALL debt which is not Secured with little exception.

        If you don't already have a copy of your 2006 tax return, you should order that (or the transcripts) which is free now. That call took me just 5 minutes. My next steps over the next day or two involve reading through the Nolo e-book, and taking the first counseling class online.

          Just for your info guys. There were 2 books at Borders (in Santa Barbara) written about BK and the new law. They may be helpful and you can just go and read them at Borders.

            There are links to .pdf files of all the Forms available there.

            Toward the bottom is a link to the Draft Bankruptcy Forms Package. There are a few Data Enabled Forms there you can complete online and print out.

            Unfortunately, the Data Enabled Forms Project is not yet complete. Evidently the BK Software Vendors have not adopted the Forms. You can read about it here:
