Our 341 was last week. As I posted previously, I think it went well. Trustee didn't ask for recent bank statements or paystubs, although we had been instructed to bring them. The only thing he did ask for, which we didn't have with us was our 2006 tax return....we filed our taxes AFTER we filed BK. Atty was hoping he wouldn't ask, because our gross income last year was 6K above the median. But, alas, he did.
I haven't faxed them to the atty yet, because we filed online and I didn't have a paper copy. I finally found the online stuff last night and printed it off, and will get it to them today along with a letter explaining that our income will be lower this year, as I won't have all of the overtime I worked during the first half of last year. Also, my DH must take graduate classes to keep his teaching certificate current, so we have that additional 5K in tuition.
I have a couple of questions, though...
1. I've read several posts on here that discuss being over median on the means test, but being "fine" on the schedules I & J. When I asked atty about this, after our 341, he said, "no, if you are over median, you automatically have to convert to Chapter 13, regardless of the I & J. Can someone clarify this for me...we are in Michigan (western district), family of 5.
2. I checked PACER last night and it said: "6/6/07 341 meeting adjourned, awaiting discharge". It also said something about "341 final meeting....7/31/07"...last day for objections 8/5/07. We haven't rec'd notice of any other 341 meetings or anything like that, so is that 7/31 date just record-keeping, or what? I was happy, I think, to see the "awaiting discharge".
