    Question re: non-debtor spousal income

    Has anyone had experience with this? Combination of husband & wife income is below state median. So no presumption of abuse, right? Only Husband is to file. However, as I understand it, wife's income still counts towards income test, but if combined income is below median, doesn't the review stop there? In other words in a Chapter 7 like this, can trustee or someone still look to wife's income to somehow fund a repayment to creditors, which I guess would be like converting it to a Chapter 13 (which I thought you can't do if you're under the state median)? Sorry if this sounds so convoluted!

    If both of your incomes add up to less than your state's medium income you should have no trouble filing a Chapter 7.
