    property after bankruptcy

    ( penna.)
I filed bankruptcy in 2004 in my own name for unsecured debt. (CC). This proceeding was eventually dismissed approx. end of 2005. I jointly owned property with my spouse which I was advised by my attorney that this could not be affected. We are now considering selling this property and wonder if any negative info. would be against the title. We were advised that this was not possible in Pa.

If the case was dismissed or discharged then any property you own is not part of a bankruptcy estate and you can do as you wish with it so long as any sell is legal
May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
September 4th, 2007: Discharged and Closed.

The only way to find out if there is negative info on the property title is to do a title search of the property....... this will uncover any "mechanics liens" or any other kind of liens/judgements that may have been filed against the property.

If your case was "dismissed" and not "discharged" any creditor could have filed a lien/judgement against this property even though you only own half of it........

If your case is discharged and closed - then the property is yours to do with as you see fit......

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.
