    I was doing good not worrying now this comes up..HELP

    I decided not to worry over this BK stuff then this comes up. My BK filer calculated our monthly income correctly but not the deductions. She used the deductions per paystub instead of using monthly which makes it look like we have more take home pay. Today is the deadline for the schedules to be in so is is possible to correct this today???

    I was wondering why we look like we had so much money that I never ever see LOL> I know some where out there this mistake has been made so I know they have to let us correct this.

    Please let me know what I need to do, I can't reach her and the BK office closes at 4 pm. How do I get this corrected??? am I worrying over nothing and they will allow me to correct this??? thanks gang in advance.

    Okay are you filing pro se or with a lawyer, I can't remember.

    Anyway from my understanding its not that hard to fix. If nothing else file what you have. Then you'll need to file an amended schedule for the incorrect one (Which I assume is Schedule I).

    It costs 29 dollars with the court to file an amended schedule plus whatever your lawyer charges. (Though if its their mistake they shouldn't charge more than the 29 dollars to pay the court).

    Still you need to get hold of the lawyer/preparer and let them know about the error. You need to get it filed on time so they don't dismiss your case though.

    Like I said you can amend after filing Maybe others will chirp in too and offer more specifics
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      we filed pro se, I will take care it today, I guess it really isn't a big deal I think.

        You could go to the courts website download the appropriate forms and possibly get them filled out in time. You'd need to amend I and J I think since you have to compare the two.

        Anyway yeah its not uncommon for folks to amend schedules from what I've seen. Costs 29 dollars per schedule after filing to fix it.

          Do I include the paystub along with the new figures??? I was a simple mistake so I am not upset with her but this is my BK and I can't afford for it to be dismissed.

            It wouldn't be a bad idea to include a copy of the paystubs as "proof of adjustment"..... so they can see the proof is in the pudding so to speak.....

              Okay, feel much better. to amend schedule I an J all do is send the corrections to the court house and it is free. this is the only part of the schedules that is free. I spoke to someone at the court house and they told me that I can amend at anytime even after the meeting but I would not want to wait that long. I worried about nothing, so back to not worrying again.

                Be sure to check the Local Rules and see what Forms and Schedules your Court requires you submit to amend this error.

                Some Courts only require the one Form or Schedule that's being corrected to be submitted.

                Some Courts want every Form and Schedule resubmitted.

                Also, some Courts define if and how you are to denote the Amended Form or Schedule.
