    I filed my statement of intent for the car, I'm surrendering it.
    Do I need to surrender it before I go to creditors meeting?
    I thought I'd wait to see what trustee says about it, then surrender the day or so after the 341.

      You can ask the trustee about it if that makes you more comfortable. But I wouldn't do that at the 341, trust me that is not the time to try to have a convo with the trustee. They want your answers short and simple and you to move along and the next person to sit down. It will be asked to you at the 341 if those are your intentions (surrendering) and for you to verbally verify yes or no.

      Unfortunately this is the time when having a lawyer comes in handy, really it's the creditor holding your car loan that you need to contact in regards to how they will handle the surrendering of your vehicle, i.e. they pick it up, you drop it off. Also to give you an estimated time frame. Sometimes it is them that will contact you regarding the surrender. Technically though they can't talk to you. Sometimes they won't talk to you because it can be constituted as violating the stay, but you have to talk to them to get the information. Hence this is the part of filing pro se that's a bit nerve racking. Call the creditor explain your situation, more than likely you will be transferred to their bk department, and then question them how they want to handle the surrender. Sometimes it can happpen fast and sometimes it can take months for them to get around to it. Or you can wait until they contact you.

        The bank did contact me a week after I filed asking me what my intent was regarding the vehicle. They said that because I was pro se, they contacted me and are allowed to ask me what my intention is.
        I merely told them that the court gave me until July 30th to decide.
        They asked 'so, then what is your intention'
        I repeated again that I have until July 30th to reply.
        They didn't contact me again and so far no motion to lift stay has been filed! I'm gonna surrender it after the 341 meeting since I don't have a ride to get to the court, that is over an hour away!

          ohhh.... should I also give the trustee my paystubs before the 341 or during? i forgot to ask when I called his office!

            Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

                hi....i actually got copy of questionaire from my lawer who has dealt with my trustee.
                he said he is tough but fair...i answered all the questiones in my head...no sweat...just simple yes and no...just tell him what he wants to hear but not too much....simple truths and you'll be out of there and on your way...couple of minor points with my case and my 341 is fri morning. I will post in the morning after the meeting and will let you know what happened with mine..
                you will do fine...hardest part then wait in the 60 day club...good luck...guzzie

                  I would send the bank statements along with the pay stubs before I think you are supposed to file the pay stubs I had to give tax returns not pay stubs so I am not sure because they willl not allow you to file tax returns you have to fax them to the trustee I would call the clerk to find out if you need to file bankstatements and or pay stubs. it would not hurt to file them and send them to the trustee cover both bases

                    The court sent me list of any required documentation, and paystubs/tax forms were not included on the list.
                    I'm sure they would have sent me a deficiency notice, like they did for my schedules and the course that I have to take.

                      to be safe call the courts, trustees don't like it when we are not prepared especially use pro se filers. I got my paperwork ready in a nice folder with tabs that mark bankstatements, tax returns, pay stubs, my certified truth letter of explaination of something he may question (simple two sentence statment in regards to my previous employment and how I was paid vs expenses but not give to much) I am making the file nice and neat so he will have no problems or need to ask any further questions. The clerks told me how to do this and this helps your case out a lot, this is how lawyers submit files. I am still debating on explaining my health situation and my daughters. I have a 1 1/2 weeks to decide on that. I am nervous about my meeting but also eager to get this over with and look forward to my new life.

                        I hope this bk process goes as smoothly as my husband's immigration.
                        We both spent MANY restless nights worrying about having all the correct documentations submitted to USCIS and the consulate, and what will happen at the visa interview... will my husband be approved or denied - is what we were thinking. That somehow they'll think our relationship is a lie!
                        We over-prepared ourselves by taking with us to the interview copies of everything filed, my financial docs, and proof of our relationship (phone bills, photos, etc).
                        We get to the interview carring what seems like a briefcase full of backup documents.... it takes 10 minutes and he gets his visa without the interviewer asking for anything!

                        I have a feeling that may be the same case with the 341 meeting... I'll go with a million papers, thinking the trustee may ask for copies of something or other, worrying the whole time beforehand... then it's over in 5 minutes and I fretted for nothing! lol
