Creditor sent me to collections after I filed

I had two creditors send me to collections after I told them I filed. Do I amend my creditors list to add the new collectors names??? I mean they really did this, I though that was illegal, I thought they were suppose not be able to do anythingk while I am in chapter 7???? You guys know I filed on June 26 and just yesterday I get a letter from a collections agency. It was those payday loan places.

Did you list them on your creditors list? Stupid question but I had to ask, sometimes people forget to list all of their debts.

As far as them sending you to collections, no they can not do this after the filing. A swift call to them should correct the matter. However make SURE they have not reported you to collections on your credit report also, if this has happened get them to correct this also.

As far as amending your list, honestly you shouldn't have to as long as you listed the original creditor. You can always amend it if it makes you feel more comfortable but otherwise it really isn't necessary at this point. Listing the collection agencies will only give them notice of your bk so they won't hassle you. Most of us only listed the collection agencies if they were actually collecting on the debt BEFORE filing, since this is after your filing it's not going to effect you.

You can either ignore their notice, and just make sure they have not affected your CR or you can contact them and inform them of your bk and give them your case # just to make sure they get the point. Also give them a stern "Do not contact me again or attempt to collect this debt any farther, in doing so you are in violation of the automatic stay."
