    Home Asset Inspection??

    during my consultation yesterday the attorney said that there is a 50/50 chance of the court sending a person to my home to inventory my belongings. He said to be sure to list any and all guns I may have. Do these things sound normal to all of you?

    When you spoke with your attorney did you tell him you had a gun collection? Did you mention guns at all? That seems rather odd. From what I have heard it is rare for any inspections of assets. But I'm only familiar with cases where people list basically garage sale quality belongings. So did the attorney bring this up out of the clear blue sky?

      Never heard of that before. If you have an asset case then I suppose it's possible (to come collect the assets). If everything is exempted then there is no reason for anyone to inventory. They are counting on your good faith to list everything truthfully.

        Yes he basically hit me with that out of the clear blue. he said to expect a 50/50 chance of this inspection and to be sure to list any and all guns. I told him I have one pistol worth about $400 and he said they will want that. It was a very strange meeting indeed. He then told me that if I have a Louis the thirteenth chair or something like that to snap a leg off of it and tell the inspector to take it. Maybe he mentioned guns because any you own (legally) are recorded with ATF or FBI or some agency. Maybe they pull a list of them? They can have my nine mm. I don't really care.

          I don't know of anyone around here that had anyone from the court come and inspect their property. I wish you luck

          Also I would think the pistol might be included in a wildcard exemption. I'd perhaps talk to a couple more attorneys in the area.

            Have you seen any other attnys???

            If not,............ I'd suggest you schedule at least a couple more Consults with a couple differnt attnys.

            Sounds like this attny is a bit tetched in the head.

              It is hard for us to give an informed opinion either way...on the one hand, the trustee has the right to send someone to your house to inventory your possessions. However, 50/50 odds is a bit extreme, its probably more like 1/100. But at the same time, maybe the attorney knows that the trustee(s) in your district are more anal about these things.

                I highly doubt anyone would come...but don't offer up any more gun inventory but list what you already have disclosed. All of this should be covered by your exemptions....again, find another atty.

                They do rely on your good faith and while they have the right to inspect, with so many cases now few would ever conside it in my opinion.

                  I agree, it is not likely the trustee would send someone.

                  The only time I have seen it happen is when debtor closed a business and most of the business assets were at the debtor's home.

                  The other time I have seen the trustee send someone to a debtor's house was when the debtor had some non-exempt vehicle, i.e. 3rd car, camper, motorcycle, etc.

                  But generally, having the trustee send someone is not something you need to worry about, and if they do send someone out, it won't be by surprise, they will call and set up an appointment with you.

                    I have a question on wildcard topic. I believe here they call it any other property and it is for 4,000.

                    Can you only list one thing on this wildcard exemption or are you entitled to list two or three things with that. For example one person had a car & his exemption for the car was 3000 but his car is worth 4000 so they put the other 1000 value of the car onto the wildcard. Let's say they also have 3000 dollars worth of tools and furniture. Can you add those to the wildcard?

                    In other words, Does this leave the other 3000 remaining on the wildcard for other things that someone owns or can you only put one piece of property on your wildcard?

                      Yes, unless your state says something about limiting the exemption $ for any one item (which I doubt), then you can use it to exempt ANYTHING. Although, any tools or furniture should be able to be exempted using an existing non-wildcard exemption. Each state is different though.
