    Help! ASAP!

    I AM SO FRUSTRATED RIGHT NOW! I am scheduled to file in less than 2 hours and my lawyer had some last minute things I needed to get so I went to the bank. I just found out that my husbands account which he asked to have me removed from is still JOINT I apparently needed to fill out a paper to have myself removed. I went ahead and filled out the paper to have myself removed, but I am sure that will raise red flags if the trustee digs. I do not want to tell my attorney because it has already taken so long for me to get my appointment to file.

    I am the only one filing, and I only use my checking account, not his. I mean if they looked they could prove that with his paystubs being the only thing depositied into "his" account.

    My question is this... since the bank statements are ONLY in my husbands name, will they find out? Can the trustee have access to our accounts, or will they only look at the bank statements that we provide? I mean my name is not ever on our joint account on the statements, they are sent in HIS name and they use to be sent in the both of our names, which is why I never knew that I was still on his account. It has been like that since last year sometime.

    How does the trustee find out info? I mean can they access your accounts, and dig around? I have nothing to hide, I just do not want another holdup and technically I am not on his account anymore.

    PLEASE HELP! Thank you! Geez, I need a tranquilizer or something, I mean I am really taking this hard, and freaking out about filing

    I really would recommend you discuss this with your attorney.
    He is the one who can really answer these questions and he is the one who needs to know this information.

      When you file the Trustee is in "charge" of your affairs...... all of them..................He will know your business as well as you do when he gets done...... So don't be closing anything, trying to hide anything, etc... It will come back and bite you in the A##.
      Be sure you tell your attorney about taking your name off the account.... cause the Trustee will find it out anyways.

      Legally, half the money in the account is yours and the Trustee may decide he wants half of it.... to pay your credits. This may be unavoidable. Time will tell.

        Thank you so much for your responses. I was actually suprised at how awesome my attorney was today. The first time I met him he was stuffy and I was not very comfortable around him, but today he was alot of fun joking around with me. I told him about the account and I showed him the statement in my husbands name so he knew that I was not making it up. He believed me, wrote down all the info and said it should be okay. He made me very aware that honesty is the key.

        So there ya have it. I feel a HUGE weight lifted off my shoulders, and I went into that meeting today with alot of knowledge thanks to everyone here! I love this site!!
