I guess it also depends on your case. Our trustee looked at our deed to the house and our truck titles. In our case he didnt look at our tax returns or bank statements but our attorney had all that before anyways. On the petition you have to write your W-2 earnings for last year and year to date but he did ask about 6 other cases for their tax returns and statements. One guy had withdrawn $3000 from his account the day before he filed and the trustee wanted to know where it went and wanted receipts. Otherwise the trustee just asked the normal questions. Name/address, if you listed all your assets and debts, if you paid family members any money in the last year, etc. It was over within 5 minutes for us. I mean the trustee gets your petitions ahead of time so he already knows what he is going to ask you. Just be prepared and it will all go just fine.

Ok - sounds simple enough. I know I'll still be TERRIFIED I just get like that...i suffer from mad anxiety and I'll be concerned that I won't know how to reply or speak properly for myself

I also wanted to note that my attorny has been GREAT SO far. He is very informative and has done a lot of work...checking stuff and keeping close contact with me!! Which surprised me! He also took my creditors calls as soon as I made a payment to me (not paid in full either!). He insists that I'll only need my DL and SS card...

I had my meeting last Friday and it went very smooth. Do the creditors have 30 - 60 days to protest/object???

          Anyway the questioning was basic:
          Is this your signature?
Did you list all your debts?
Did you list all your assets?
          Do you own any property?
Have you had any cash advances on charge cards in the past 90 days?
Does anyone here have any questions for missy2??
          Not a soul.
After the swore me in they took my license and ss card - and that was all the paper work I needed. The lawyer just sat there with me...

All the cases that I witnessed in my 90 minute wait - NOT one had a creditor show up.

Take everything which has been mentioned. Even if the Trustee doesn't ask for it, you don't want to be caught without the proper documents. That will look like you have something to hide. And the last thing you want to do is have to go back into that damn room after having already been there once. It is bad enough the first time, even if it goes well. Have everything, and be prepared, because if your bank statement doesn't show a low balance(your state minimum) on the day you filed for BK, the Trustee could make you pay the difference to the court. For example, if your State says you can only have $20 in your account when you file BK, and your statement shows you had $700, you might have to pay the court $680! Even if that money is long gone. I saw that happen to a few people at my meeting. Good luck!

Hey FloridaGirl - I already had my meeting and I only needed what my lawyer told me to bring: my license and ss card!

I think it depends on where you live, at my 341 the trustee asked for everyones tax returns this year and last. My attorney told me we probably wouldn't need it but bring it any way.

FIRST CALM DOWN - no need to get in a up-roar until you know what's going down. 341 Meeting will be short and simple more than likely. Yes, have past Income Tax records, bank satements if needed along with SS and DL.
If not needed, that's a good thing.
Most Chapter 7's are quick, simple and basically painless.
Course we all worry ourselves sick over things like this.
Most Chapter 7's are File, 341 Meeting, and Discharge a couple of months later and its over.
Most do not have any major problems arising.
Good Luck, calm down, and be patient.
                    Minny

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

my husband and I did the same, we took absolutely everything, W-2, bank statements, pay stubs x 2 months and tax returns (we had to pay), SS car, DL, 401 K statements and every one of our vehicle titles. I agree, the more prepared the better. However in our 341, we didn't have to show anything except my car title ( its paid for, not worth much, 92 toyoto celica). We had a little comedy routine with our 341. when the trustee asked for my DL and SS card, my hands were shaking so bad, I couldn't get it out, then I dropped it, when I bent over to pick it up, I hit my head on the table. the trustee kinda smiled, then said "you'll be ok, just relax, you're not going to a lenching or anything". he had a very kind smile, was reassuring. Our 341 was not painful, it was the waiting that was painful. we just found out yesterday via mail, out discharge was june 7th. now holding out for the next year!!!!!!
