    Proof of Claim filed in Pro Se case - Do I have to respond?

    I have taken a lot of information from this forum in order to file Pro Se, so thanks for all the help.

    I've got through my 341, and my case has been declared no asset/no distribution.

    A Proof of Claim has appeared in PACER for me though, and I'm wondering if there is anything that I am supposed to do in order to respond to it, or will it just be dealt with in the discharge?

    I've searched around, but can't find any specific info on it.

    Thanks for any and all help.

    What is the proof of claim about? Does it say?
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      proof of claim is in case you have assets they can get paid but since you are a no asset case they dont get paid anything anyway it was actually a waste of that creditors time to file a proof of claim
      Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

        In a chapter 7 case, you generally don't need to do anything with proof of claims. If the claim is wildly inaccurate, you could file an opposition, but even then, the claim does not effect you, it merely effects other creditors and the trustee.

        Under the old law, if you were cramming down a car, you would want to scrutinize the proof of claim submitted by the car finance company, but cram downs are now rare.

        In short, no, you probably don't need to do anything.

        In a chapter 13, the DEBTOR MUST review the proofs of claim for accuracy and object as needed.

          Great, thanks everyone, that's what I needed to know. I just didn't want to miss a form or something.

          The claim was for past utilities, and I have no reason to object because it is accurate. It does seem a waste of time since there are no assets, but I'm assuming it's possible that with a utility it would be an automatic response.
