    Pacer question

    Hi,

    I had my 341 meeting on September 26. Pacer stated this Meeting of Creditors Held and Disposition Pending (Rinn, Michael) (Entered: 09/26/2007).

    I turned in the second part of the counseling on 10-03-07.

    How long is it going to take the trustee to make a decision on my case? Does he have a timeframe or can he take as long as he wants.

    I would like to know IF the bankruptcy will be discharged or not. The only creditor to show up in my case was my mother( who I don't get along with for numerous reasons). (Background information)She paid my car off in March 2007, I was paying her, then in April my then finance' was in an accident that totalled the car. She advised me to TAKE the money I was getting from the insurance company and get another car. Which we did, but to get the best deal, my then fiance' purchased the car under his name and got 0% apr, but we could not afford 2 car payments, so I talked to my mother and she agreed to take 100.00 pymts each month. Then in June she called and said that if I don't pay her the entire amount she was going to SUE me. Well We did not have the 12,700 to pay her off. She would not accept pymt arrangements. So I talked to my Lawyer and she said to file.

    Fast forward: I got married on Sept 15th, and had my 341 meeting on the 26th, in which she gave a MAJOR sob story to the Trustee and here we are waiting for an answer.

    I need to know If I need to get a Part-time job in addition to my Full-time job so I can make enough money to settle with most of my creditors. We are planning to on trying to buy a house in a year and a half.

    Can someone please advise??

    No, No, No. No "settling with your creditors" will be happening. As I hope your lawyer explained, you will be getting a full discharge of most if not all of your debts, including the one to your mother.

    I suppose you could pay her after you are discharged, but NOTHING before then.

    Get another job to increase your income, but as far as the unsecured debt you incurred prior to your filing date, that is going to be discharged and you will never need to pay it. This is assuming, of course, that your case is a regular no-asset case. Is it?

      Yes, I think I'm a no asset case. I filed single and I have a daughter. My income is about 50k, but for Maryland the median income for a family of 2 is about 65K. I have no money in my accounts, no savings.

      When my car was totalled I recieved about 9100 for my car, but that was a down-pymt for another car, which I need for work. ( I travel from Annapolis, Md to Reston,VA several times a week and need a reliable car) My Mother knew about the new car.

      If the trustee is considering the 9100 that I received from the insurance company for my car an asset then it would be an asset case. My husband has a car, but it is a 1997 Honda Civic has over 150k miles on it and was in a major accident 5 years ago and it is worth about 500.00

      I just want this to be over with. The waiting is so hard. I know that my student loan will not get discharged, but I hope that everything else will.
