    Glimmer of light at the end of the tunnel?

    Ok-

    I have more questions.


    I was the poster whose car company was asking for arrears in the amount of 2200 or the car company was going to repossess the car.

    Well, since my husband did not file bankruptcy, he was able to take out a loan in the amount needed to bring the account current. (Interest free too!) I am going to pick up the check in the morning.

    Here is my question

    Should I get something from the car company in writing saying that they will allow me to reaffirm the car before I send the check??

    The check will bring the account current. Do they have to let me reaffirm the car??

    Can the repossess the car if the account is current?

    I feel like this loan has lifted such a weight off my shoulders. The car that we have now is at a 6% interest rate so I was really stressed about losing it. We are upside down though, but since my husband did not file, if the car is repossessed I think they will auction the car and then sue him for the deficiency balance.

    Sorry if my post is rambling. I hope it's not to confusing.

    If your husband is not joint on the auto loan and you don't live in a community property state they can't hold him liable for any deficiency?
    If you're upside down and there can be no recourse to your husband, I'd let it go.
    They can't repo if you have not been discharged. You are still protected by the automatic stay.
    If you're current, they'll leave you alone. They want money-not the car.

      My husband is joint on the loan, and I believe we do live in a community property state, CA. Thanks.
