    Car accident within 180 days post filing

    We had a car accident a day or two shy of 180 days post filing.
    We are hoping to receive $900.00 for damages through the other party's insurance, they claimed liability.
    Our car was bought back from the trustee in the summer in a lump sum. We were discharged shortly thererafter.

    1. Do we tell the other party's insurance we are within 180 days of the BK window?

    2. Do we notify our trustee at all? Does this concern him?
    Even though we bought back the vehicle, would he still be interested in the 900$ that would cover damages to our car?

    3. Is it true that technically, we won't be "entitled" to the money until the adjuster says so, regardless of when we made the claim?

    Does the 180 days start the day you file, or the day after.
    If it starts the day you file we just made it by one day.

    11 U.S.C. 541 states what the trustee can take within 180 days.

    It does not mention anything about car accident claims.

      Do we still have to tell the trustee about it?
      We made the claim on the 180th day. ( Even though their insurance company hasn't approved the money yet.)

      I thought any insurance settlement had to be reported within the
      180 day BK window, regardless.

        Only inheritances, divorce settlements, or life insurance payouts are reportable in that time period.
        Unless I'm mistaken.....?

          No, you do not need to inform the trustee. The event, car accdient, occured after filing.
