I'm in WA state - met w/ attorney and plunked down a retainer. He said I qualified for a Ch 7. I was worried, because my kids receive SS benefits from ther father's retirement, but since it is SS monies, and I don't use the money for household expenses, it is not considered income. Question - if I use that money to pay for private school for the kids, would that be considered a "household" expense?
I'm letting go of my house and car in the BK. I plan on buying a clunker - and have the money right now to do it. Should I buy it now, and just quit making payments on the car? I plan on not filing for another few months.
On the expense schedule, I wouldn't be able to put the car payments and mortgage on it, so would it be better for me to keep the care and just not reaffirm it or redeem it? I'm a little worried that if I let both of them go, my expenses might leave a little left over, throwing me into a Ch 13 situation.
