    Worried about my home!!!

    I posted this on the general discussion, but only got one response....

    My husband and I are getting ready to file Chapter 7 this week. Our attorney said that we should be able to keep our house, but I wanted to get some feedback from those who have been through it.

    Our assessment paper says that our house is worth $108,500 (although our house was appraised for $104,000 in 2003 and last years tax records says that it is $93,000). We owe $90,000 on our house. We live in SC and get a max exemption of $10,000. The attorney said that for the courts to break even, they would have to get $119,000 for our house. BTW, we have never been late or missed a payment.

    Does all this sound right? In your opinion, should we be able to keep our house?

    If that is what your attorney is saying, its probably ok. The value test for a house is market value, so they probably won't go off of the assessed value. Incidently, if you assessed value is higher then the appraised value, you should challenge the assessed value to save some money in property taxes.
