    Are Judgments Exempt?

    Anyone understand this? I was a plaintif in civil case that got thrown out on appeal....yes it sucks to win then lose. I now owe court costs of over 40,000 and that is not counting the legal fees the other sides has asked for in the six figure range. Will a BK get me out of this since I was origionally not the one being suied?

    Some of the FAQ state that judgments are not exempt but all they talk about is child support or criminal. Anyone know the awnser?

    Did you say 40,000 looking up info now.....It depends what is the 40000 for in court cost for?

    debts the survive BK child support most taxes student loans, fraudlent wiling and malicious acts on your part, Domestic support obligations- fines, Penalties and restitution that a fed, state or local government has imposed.

      Exemptions have to do with whether the debtor can keep the asset, not that a debt is exempt from discharge.

      Typically, if a debtor has a judgement against them, it can be discharged unless the underlying act that gave rise to the judgment was fraud or some other malicious act.

      So, if YOU file BK, you can get the judgment discharged. (but you need to take the extra step of taking the discharge to the court and having the judgment vacated.

        We put our judgement in our BK and have had no problems thus far. I agree with HHM 100%.

          I included several judgments in our BK and have had no problems. Once I'm discharged, I plan to get them all vacated.
