    Court Dates???

    Hey guys.. I recently recieved to lifts for automatic stay.. One for my Car which I am surrendering and one for my House which i am surrendering but am still living in. Today I received a court date for the car? Do i have to attend.. They can come and get it i dont need it. I figure i will soon receive one for my house. What about that one. Do i have to go and how long till i get evicted? Thanks guys..

    If you do not plan on opposing the motion, there is not reason for you to go to court.

    As to the house, the Bank still has to go through the normal foreclosure process after the Lift Stay is granted. So, you probably have quite a few months before you would need to leave. But, you can stay up until the bank actually evicts you from the home. Stories are circulating about residence continuing to live in their home for many many months after the foreclosure was complete (i.e. because the bank could not find a buyer and the bank hasn't moved to evict the prior owner).

      so basically i can stay till they put a eviction notice on the door??

        For the most part, yes.

        But many people are uncomfortable with that level of uncertainty, most people tend to move out on or before the foreclosure auction date.
