    How long can the Trustee keep my case open?

    I filed Pro-Se Chapter 7 (No-Asset) in October 2005. Case discharged in Feb 2006. My case still isn't closed. I called the court, they said the trustee hasn't filed the "No asset report" and they can't close it until then. I've left several messages for the trustee to call me to explain this to me. No return call. In April 2006, the trustee made a motion to the court to employ an attorney to recover assets. His motion was granted. Pacer isn't showing any new transactions since April this year? Legally, how long can the trustee keep my case open? This is getting ridiculous!! Can I make a motion to the court to close the case? Thanks in advance!

    I know what you're going through. I filed same month and year you did, discharged same month and year as you and case was not closed until this past Novemeber. I was an asset case though, but it was for a few pittons of my 2006 IRS refund, which the Trustee received in April 2006........waited 19 afterwards for the closing. My point is, closing the BK could possibly take a while....asset or not. But really, your case is over and closing is nothing more than an adminstrative thing. Having an open case does not hinder your ability to move forward with your life and finances. Yes, it's frustrating, and I know you want to close this chapter, but don't worry too much about this.

    Case Closed - 11/08/2007
