    341 this Friday

    Our 341 is this Friday morning...wish us luck. We're WAY over the median income, but passed the means test easily. Our attorney is 99% certain our trustee won't even blink about it, but I'm worried, of course.

    We've turned in all the documentation the trustee wanted, plus some extra - I didn't realize I was giving the past 12 months of bank statements until after I'd turned them in (the trustee only asked for 2007).

    We filed 11/29, and in the past week we've received several bills and dunning notices. Our attorney said to bring them to him on Friday, and he'll check into whether or not it's a violation of the stay (whether they'd received notice or not).

    I'll let you know how it goes!

    Look at the dates those bills and dunning notices - when they were generated and sent. If any time after the 29th or 30th, yes-they did violate the stay. If before then the "glorious" mail system is the culprit. Remember - mail starts to really move slow after Thanksgiving.

          Good luck, we were over the median as well! The hearing is no big deal. Being over the median I think warrants a savvy atty that is very familiar with the laws and how to work them in your favor.

          Just waiting on our discharge in our very busy district...
