I'm curious to know how long it took to receive discharge. We filed 3/7/05 and had 341 meeting on 4/7/05. The deadline for Creditor objections was 6/6/05. I know it's only been a week but I hate the waiting game.

hi lin, i too am in s.c. and are just beginning my process. if you don`t mind can you give me some info about how your 341 meeting went and does s.c. provide you with a trustee, i am really nervous about all this and would love to know about what to expect. my lawyer has set me up an appointment with a paralegal on the 21st. did you have a paralegal also?

Thanks, good to know that it was only about 2 months after your creditor meeting. My creditor meeting was 4/7/05 and the deadline for creditor objections to discharge was 6/6/05. I was just out on Pacer and didn't see any change in status yet. It also didn't show the creditor objection deadline as terminated yet either. Hopefully, it will be over soon.

We used an attorney and only met with him throughout the entire process which went smoothly. We received a few requests from his paralegal to produce certain documents prior to our 341 meeting but that was the extent of our dealing with the paralegals.
When the paralegal files your BK, you're case will be assigned to a Trustee for your area. You'll probably get a letter within a week of filing telling you who the Trustee is and when your 341 meeting is scheduled (ours was 30 days after filing). We were told that there are 2 in our area - one relatively easy and one pretty tough on all debtors. Of course, our case was assigned to the tough Trustee. Thankfully our attorney told us what to expect from the Trustee - about a week after filing we received a letter requesting several documents such as title to vehicle we own, proof of car insurance, copies of cancelled checks for past 3 months, copies of bank statements for past 3 months, we had to provide a detailed listing of how we spent our tax refund, we also had to provide an updated payoff for our other car with loan, and provide a copy of our current lease along with our landlord's phone number.
We sent the requested info to the Trustee via Certified mail. Our 341 meeting went well and only lasted approx 5 - 10 minutes. I had several concerns because the one car we own without a lien is slightly over the SC exemption and we thought the Trustee would want it. Our attorney also stated that the Trustee might try to contact our Landlord to get our security deposit as well. The Trustee was direct and asked the obvious questions we expected, about our car and our lease but at the end of the meeting he stated that we had a no-asset case. We got to keep our car and the Trustee isn't going to contact our landlord.
The anticipation of the 341 meeting and not knowing what to expect was the hardest part of this whole process. Now we're just waiting for discharge so that we can move on.
