    Converting from chapter 7 to chapter 13

    We filed chapter 7 several months ago, and because of our disposable income are being forced into a chapter 13.

    I was wondering if we have to use the exact expense items and the amounts from the chapter 7 filing? We now know that the expenses we listed were on the low end and other small expenses were not listed, that we would like to list in a chapter 13.

    Yes.. use the correct and omitted amounts on your new schedule. Even in the BK7, you would have been able to amend your expenditures at any time before discharge.. however, as I found out, that is something you really want to do right the first time!

    Who knows.. maybe after you've reworked your numbers, you won't be a 13 afterall..<one can hope, right?>

    Have you used the calculator that is pinned in this forum? It's awesome.. you fill it out and then you can print it... does the math for you and everything. Great Tool!

      I won't find out for sure until 7/12, which is our discharge date from chapter 7.

      We did not amend our expenses because up until our 341 meeting, our attorney thought everything looked good (we had $300 disposable income). The Trustee said he was going to recommend not allowing certain expenses which would leave our disposable income at $900!!!

      I was looking ahead since I believe the US Trustee probably will agree with the Trustee, which from what I have read they seem to almost always agree with each other?

        Ratz.. LOL.. I participate on a few boards, the caluclator was on another.. here's the link. Pay no attention that it's from California.. that doesn't matter. I just cut the header off.
