    Surrendering vehicle!!

    Hello everyone,

I have a question regarding the vehicle that I surendered in my Chapt 7 Bk. I filed back in August, have not made a payment to the bank since July 07. The bank's attorney filed a Motion to Lift the Automatic Stay. The Trustee granted that motion. To this day I still have the vehicle and I received my Bk discharge on 12/14. The bank has made no attempt to contact me or to pick up the vehicle. I tried calling the attorney and left several messages regarding making arrangements to return the vehicle. I never got a call back.

I'm eager to return the car, because I'm still paying for full coverage insurance. I'd rather be safe than sorry.

Has anyone ever experienced this? I'm not sure what to do. I park the vehicle outside hoping that they would pick it up...but NOTHING!

They will come. Just park it in a convenient spot for them to get to it. Clean out all your stuff. One day you will wake up and voila, in the middle of the night, they will have come and taken it off your hands.

Can't you just drop it off at the bank and throw them the keys?

I received a phone call from the bank regarding my lease about three weeks after filing.

They wanted to make arrangements to pick it up at my convenience with a flatbed. I didn't want to talk to the person, so I e-mailed her instead and set it all up. Not a bad experience at all.

PLEASE NOTE: I am not a lawyer. Bankruptcy may or may not be a best scenario for you. It depends on your situation. You may assume my advice is totally useless. Talk to an experienced bankruptcy attorney (or three) in your jurisdiction for legal advice.
