    another tax return question

    Hi all,
    I typically get less than $1000 back for a refund, usually about $700. I turned in the past two years to the trustee and the last day for objections is this friday, the 18th. I just did a rough estimate of our taxes for this past year and we are going to get back about $2500. My husbands job took out a huge chunk from our playoff shares apparantly.
    Would the trustee have informed me that he wanted the return? Or can he find out the amount?
    Would it help to wait until March or even April to file?

    First of all what did you turn in to the trustee - copies of two years worth of tax returns? Are you filing Chapter 7 or 13?
    In either case - you filed bankruptcy last year... the trustee already has your tax returns for two years. If at the 341 hearing you are asked what your refund will be, just shrug your shoulders and tell him/her that you will file your taxes on April 15, and that as of today, the 18th you don't have the foggiest idea. I'm sure that the bankruptcy court/trustee will conspire with the IRS to steal your refund to line the creditors' pockets once you file and the refund becomes imminent.

      I have already filed (10/12/07) and am going to be discharged on Friday. He didn't ask any questions about taxes at my 341. He had my 2005 and 2006 tax returns, which showed $575 and $900 refunds.

        Amelia, I think that if you can wait, you should wait. Your case should be closed as well as discharged by April 15, right? Much safer *after* it's closed.

        Also, the Stmt of No Assets that the trustee files after the 341 includes his request to be relieved of his duties re your case, so you should actually already be fine, if he hasn't already specifically said he wants your tax return. But I sure wouldn't want to lose that $2500 either.
