Pacer question

On pacer under our status it says awaiting meeting, awaiting closing. We already had our 341 meeting on April 28 and it says teminated under deadline of April 29. And Trustee reports no assests for distribution. Our last day for objections is June 27. If any creditors or any other problems arise would I have to receive some kind of notification before June 27 or ? Im just getting nervous because its getting close to the date and all has been quiet since our meeting. How long does it take Pacer to update statuses? Thanks

So many claims are being processed right now, Pacer is behind in posting information.
You will be notified by the Trustee or your lawyer if there are any objections or is your objection date is extended for some reasons.

Thanks. I will try to calm down. ahahahah. Do you know if we didnt want to reaffirm on a vechile do we have to do that before the discharge date or can we do it afterwards?

Did you include the vehicle as a debt and tell your lawyer you were not going to reaffirm? If so, then you need to contact auto people and surrender the vehicle. Debt will be included in your bankruptcy.
If you listed vehicle as "reaffirming" - then you better contact your lawyer and get this corrected. Have you signed "reaffirming paper" with the auto company??
Better check this out before discharge - if not - you could end up paying for a vehicle you intended to surrender.

We included the truck in the petition and at first wanted to reaffirm but havent signed the reaffirmation agreement. Got the letter from the car co stating they see we filed bankrupt and we cna either sign the agreement or call the 800# on the letter to call to surrender it. I just want to make sure we will be ok with the trustee because we had that payment as part of our budget and if the trustee sees we wont have it now will he do something about that or is his job pretty much done now since he said no assets to distribute. Thats what pacer said.

I would contact my lawyer and have him contact the trustee about the vehicle being listed in your budget. You don't want the trustee thinking your reaffirming when your not. Simple to take care of - just let you lawyer do his thing!
Also call the company and tell them you are surrendering and make arrangements to pick it up.

When I told my lawyer I wasnt reaffirming that one he said trustee wont know or find out.If we dont reaffirm then our budget will be less. But my lawyer said we had so little left over (like$50 disposable income) that it shouldnt make a difference if he found out. Ugggh. Ill call him today. Better to be safe than sorry.

You lawyer is probably right - won't make much difference, but I'd still check anyways.
You want to make sure it's INCLUDED in your BK - so you don't end up having a car to pay for after bankruptcy that you don't even own now.

Better safe than sorry later!

We did list the truck in the petition but when we did we marked the little box for reaffirming same as the other truck and 2 mortgages and now we have decided not to reaffirm and havent signed anything yet. I have a call into my lawyer just to make sure it will be ok. He must think Im nuts. ahahah

I figured you had checked the box to reaffirm, that's why I suggested you make sure its in petition to include in BK.

The fact you have signed nothing to reaffirm yet will probably leave it in the petition to dismiss.

But better SAFE THAN SORRY in the long run.

I've found it to be "wise" to make sure my lawyer follows thru. They do have a lot of clients and sometimes "you" get LOST IN THE SHUFFLE OF THE PAPERWORK.

Just got off phone with lawyer. He said I could wait until after my discharge to call the bank to tell them to come get the truck since we already paid this months payment to use it as long as we can. And it wont effect our discharge at all. YEAH
