I'm nervous. Our 341 meeting will be next month and the lawyer mentioned that the Trustee will be asking a lot of questions about my mother's house. In 1991 my mother purchased a house with my and brother's name on it. She included our names only for loan purposes. Otherwise, my mother wouldn't have been approved to get this loan all by herself. Last year my brother quitclaimed and so did I later in 08/04. However, my quitclaim wasn't recorded until 02/05. The court needed add'l information, but my mother wasn't able to take care of it only until 02/05. In the meantime, my mom refinanced the house in 09/04 with my name still included. Again, she used my name for loan purposes. It's her house and I and my brother really have nothing to do with it. Although my husband and I pay rent to her, she still manage/pay the monthly mortgage, insurance herself. We just filed for BK last month, and I want to make sure that my mother's house will not be affected. What can I do or say to the Trustee that would keep me from being scrutinized too much? I asked my mother to write up a letter stating that the house is hers alone and that I have nothing to do with it and have it notarized. I'm not even sure if that would help in any way. Any advice given will be greatly appreciated.
