    Whichever is less?????

    If a taxpayer has a car payment, the allowable ownership cost added to the allowable operating cost equals the allowable transportation expense. The taxpayer is allowed the amount actually spent, or the standard, whichever is less.

    The above paragraph is pasted from IRS' website.

    Does this mean my atty will go with my average auto operating amount or use the full amount? which is $346 in my state.

    Well, since no one knows what your <average auto operating amount> is, I would suspect that your question cannot be answered with any reasonable accuracy...

      Thanks for input no it all, but won't this be found from BANK STATEMENTS ??? where else would i be spending on my car?

        It depends for what purpose, for the means test, you use the maximum allowable; for schedules I and J (income and expenses), you list your "actual" expense.
