    Just filed 2 days ago! CH7

    in the meantime we have a case managment conference that we are supposed to go to on Tues... My wife is being sued by Chase for 8k......


    My attorney says we do not have to go to the CMC because we have already filed our BK.......and said we would wasting our time... but said we could go if it makes us feel better....


    My ? is should we still go to the CMC and show the court the bankruptcy petition? Just so there is no way an ERRONEOUS wage garnishment could occur?

      Hi Techno, May I ask how many payments you missed before chase sued you? my concern is that CC gets ahead of me and sue me before I can file BK? thanks.

        Only 4 payments! Then they served us. We then filed "an answer" with the court.

        We got sued 5 months before we actually filed our BK.

            Did you at all have any contact w/ Chase before they sued you? That seems really fast.

              Yes they called me on the phone and said if I did not pay "they would send it to their attorneys and sue"!!!!

              It was very quick.... I think only 3 payments late. VERY VERY FAST. I was surprised to say the least.

                techno what state are you in? I'm hoping that since i'm in PA and theres no wage garnishments here they wont sue. I'm 4 mos past due at this point.
